B)<\/em><\/strong><\/h2>\n\n\t\t<\/div>\n\t\t\n<style>\n#col-1115389477 > .col-inner {\n  padding: 0px 1px 16px 0px;\n  margin: 0px -1px 2px -7px;\n}\n<\/style>\n\t<\/div>\n\n\t\n\n<\/div>\n<p><span style=\"color: #333333;\">Il presente documento riporta i Termini e le Condizioni Generali sulla base dei quali i:<\/span><\/p>\n<p><span style=\"color: #333333;\">1. <strong>Creator<\/strong>, soggetti diversi dal Fornitore del Servizio di Intermediazione on Line, propongono agli Utenti <strong>promozione dei propri progetti<\/strong> sulla Piattaforma <strong><em>eiDesign<\/em><\/strong>;<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong><u>PREFACE to ANNEXES<\/u><\/strong><\/span><\/p>\n<p><span style=\"color: #333333;\">All content on the Platform is the property of the Service Provider.<\/span><\/p>\n<p><span style=\"color: #333333;\">The contents present on the Creators' personal pages are the property of the Creators, who grant the Service Provider, free of charge, the non-exclusive right to process the contents for the purpose of operation and maintenance of the Platform.<\/span><\/p>\n<p><span style=\"color: #333333;\">Creators may not use the content of the Platform except to the extent that it is explicitly necessary or implied for the proper use of the Brokerage Service.<\/span><\/p>\n<p><span style=\"color: #333333;\">Users may not use the content of the Platform except to the extent that it is explicitly necessary or implicit for the navigation and\/or proper use of the Brokerage Service.<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong><u>DEFINITIONS<\/u><\/strong><u><br \/><\/u>To enable full understanding and acceptance of these terms and conditions, the following terms shall have the meanings set forth below:<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong>The Platform, the Site<\/strong>The online brokerage service, called <strong><em>eiDesign,<\/em><\/strong> che consente di mettere in contatto Utenti con Creatori.<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong>The Service Provider: <\/strong>the Holder of the On-Line Brokerage Service is, for <strong><em>eiDesign<\/em><\/strong>Nelly Dominguez De Juan, residing at Via Certosa 1, 27010 San Genesio ed Uniti (PV), Tax Code DMNNLY74A69Z131B, VAT No. 02525290181, e-mail <a style=\"color: #333333;\" href=\"mailto:info@ei-design.org\"><em>info@ei-design.org<\/em><\/a><em>,<\/em> PEC\u00a0<em>nellydominguezdejuan@pec.it.<\/em><\/span><\/p>\n<p><span style=\"color: #333333;\"><strong>Creator<\/strong>: la persona che agisce secondo quanto specificato al punto precedente, ma limita la propria attivit\u00e0 in seno alla Piattaforma alla promozione dei propri progetti attraverso la propria pagina personale; <u>the identity of the Creator must be clearly visible on the Platform<\/u>.<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong>User<\/strong>any person who accesses and \"navigates\" the Platform;<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong>Registered User<\/strong>the subject who interacts with the services <strong><em>eiDesign<\/em><\/strong> by virtue of their registration with the Platform;<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong>Terms and conditions of use<\/strong>: il presente contratto che disciplina il rapporto contrattuale tra il Fornitore del Servizio di Intermediazione e il Creator.<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong>Durable support<\/strong> : ogni strumento che permetta al Fornitore Terzo di conservare le informazioni che gli sono personalmente indirizzate in modo da potervi accedere in futuro e per un periodo di tempo adeguato alle finalit\u00e0 cui esse sono destinate e che permetta la riproduzione identica delle informazioni memorizzate; ogni comunicazione proveniente sia dal Fornitore del Servizio, sia dal Creator \u00e8 da effettuarsi tassativamente a mezzo di supporto durevole.<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong><u>2. REGISTRAZIONE dell&#8217;UTENTE;<\/u><\/strong><\/span><\/p>\n<p><span style=\"color: #333333;\">To interact with the services of <em><u>eiDesign<\/u><\/em> The User must register by providing all the data and information requested in a complete and truthful manner and thereby obtaining a personal account.<\/span><br \/><span style=\"color: #333333;\">It is the responsibility of the Users to keep their login credentials secure and confidential; to this end, Users should choose a password that meets the highest level of security available on this Web Site. By creating an account, the User agrees to be fully responsible for any and all activities that occur under their access credentials. Users are obliged to inform the Service Provider without delay via the contact details provided on the Platform if they believe that their personal information, such as User account, access credentials or personal data, has been hacked, unlawfully disclosed or stolen.<\/span><\/p>\n<p><span style=\"color: #333333;\">The User registers on the Site <em><u>eiDesign<\/u><\/em> using the appropriate form that appears on the screen, indicating, on the right side, in the first space the email address and in the second space a password of your choice, to be kept confidential. At the bottom of the spaces, the User will find a link with the General Terms and Conditions, which he must read carefully; once he has accepted these Terms and Conditions by ticking the appropriate box, the User will press the \"register\" button. Then, at the email address just sent, an email communication will be sent containing a \"link\" which, once selected, will reopen the initial form; at this point, the User will enter his email and password again, this time on the left side of the form, in the two spaces provided for this purpose; by selecting the appropriate button, the User will access his Account, identified by the email and accompanied by the password.<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong><u>3. ISCRIZIONE CREATORS;<\/u><\/strong><\/span><\/p>\n<p><span style=\"color: #333333;\">L\u2019Utente che voglia diventare Creator e formare parte della Community di Creators di <em><u>eiDesign<\/u><\/em> fare richiesta inviando una email a info@ei-design.org<\/span><\/p>\n<p><span style=\"color: #333333;\">L\u2019Utente dovr\u00e0 seguire la procedura di iscrizione compilando tutti i dati richiesti nel relativo Format attraverso il link che <em><u>eiDesign<\/u><\/em>\u00a0all&#8217;utente via email, seguire i vari passaggi, accettare i presenti Termini e Condizioni spuntando l\u2019apposita casella. A tal punto l\u2019Utente azioner\u00e0 il pulsante CONFERMA e ricever\u00e0 alla mail indicata la conferma del buon fine dell\u2019iscrizione da parte di <em><u>eiDesign<\/u><\/em>.<\/span><\/p>\n<p><span style=\"color: #333333;\"><em>eiDesign<\/em> offers <u>one year after registration<\/u> con la possibilit\u00e0 di rinnovare ogni anno.<\/span><\/p>\n<p><span style=\"color: #333333;\">L&#8217;iscrizzione\u00a0 consente all\u2019Utente del Sito, tramite il proprio account, di poter accedere al Network di <em><u>eiDesign<\/u><\/em> attraverso una pagina personale.<\/span><\/p>\n<p><span style=\"color: #333333;\">In the operations described above, the Creator will have to indicate the information requested in a complete and truthful manner, assuming all responsibility under the Law in case of misrepresentation.<\/span><\/p>\n<p><span style=\"color: #333333;\">It is the responsibility of Creators to keep their login credentials secure and preserve their confidentiality. To this end, Users must choose a password that matches the highest level of security available on this Web Site.<\/span><\/p>\n<p><span style=\"color: #333333;\">By creating an account, the Creator agrees to be fully responsible for any and all activities performed with his\/her access credentials. The Creator is obliged to inform the Service Provider immediately and unequivocally through the contact details indicated in this document if they believe that their personal information, such as User account, access credentials or personal data, has been violated, illicitly disseminated or stolen.<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong><u>4.ACCETTAZIONE INSCRIZIONI DA PARTE DELLA PIATTAFORMA<\/u><\/strong><\/span><\/p>\n<p><span style=\"color: #333333;\">La Piattaforma si riserva il diritto di approvare o meno la richiesta di iscrizione da parte di un Creator, al fine di fornire un livello di contenuto della Piattaforma in linea con lo standard di qualit\u00e0.<\/span><\/p>\n<p><span style=\"color: #333333;\">In caso di non accettazione da parte della Piattaforma della iscrizione da parte di un Creator, <em><u>eiDesign<\/u> <\/em>\u00a0invier\u00e0 al Creator una mail con la non accettazione.\u00a0<\/span><\/p>\n<p><span style=\"color: #333333;\">In caso di accettazione da parte della Piattaforma della iscrizione da parte di un Creator, quest\u2019ultimo potr\u00e0 recedere in ogni momento e senza alcuna motivazione dal contratto inviando una email al Fornitore del Servizio.<\/span><\/p>\n<p><strong style=\"color: #333333; font-size: 14.4px;\"><u>5. RESPONSABILITA\u2019 dei CONTENUTI<\/u><\/strong><\/p>\n<p><span style=\"color: #333333;\">The Creator, whose identity must be clearly visible on the Platform, is exclusively responsible for the content uploaded, published, shared or in any case supplied to <em><u>eiDesign<\/u><\/em>. The Creator expressly declares that he\/she assumes said responsibility and that he\/she will keep the Service Provider indemnified from and against any claim made and\/or damage suffered due to content provided or offered by the Creator through the Platform.<\/span><\/p>\n<p><span style=\"color: #333333;\">Il Creator, comunque, accetta che il\u00a0Fornitore del Servizio controlli preventivamente ed a propria assoluta discrezionalit\u00e0 tali contenuti e dia approvazione alla pubblicazione, fermo restando a totale carico del Creator e ogni responsabilit\u00e0 giuridica in sede civile\/penale\/amministrativa per quanto proveniente dal Creator .<\/span><\/p>\n<p><span style=\"color: #333333;\">The Service Provider, in any case and at any time, reserves the right to remove, delete, block or rectify content at its absolute discretion.<\/span><\/p>\n<p><span style=\"color: #333333;\">The Service Provider may deny access to the Platform to the Creator who uploaded without prior notice:<\/span><\/p>\n<ul>\n<li><span style=\"color: #333333;\">if the content of what is published does not conform to the spirit of the Platform, informed by the Principles of education, common sense of decency, decorum, respect for every Person, People, Nation, State, Religion, Sex, Race, Language, Culture, Tradition and Custom.<\/span><\/li>\n<li><span style=\"color: #333333;\">whether it has received a complaint and\/or a report in relation to such content;<\/span><\/li>\n<li><span style=\"color: #333333;\">if you have received a notice of infringement of intellectual property rights;<\/span><\/li>\n<li><span style=\"color: #333333;\">by order of any institutional authority;<\/span><\/li>\n<li><span style=\"color: #333333;\">if such content may pose a risk and\/or danger to Users, Creators or any Third Party or to the Platform itself.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #333333;\">The removal, deletion, blocking, rectification of the contents nor the foreclosure of the Creator's access shall not constitute any alleged breach, or exception of breach, claim for compensation, reimbursement or indemnity in favor of the Creators responsible for such contents.<\/span><\/p>\n<p><span style=\"color: #333333;\">Il Fornitore denuncer\u00e0 ogni attivit\u00e0 censurabile svolta tramite la Piattaforma alle Autorit\u00e0 Competenti ogni qualvolta il Creator ponga in essere violazioni di legge, regolamenti, ordini, discipline<\/span><\/p>\n<p><strong style=\"color: #333333; font-size: 14.4px;\"><u>6. MODIFICHE dei TERMINI e CONDIZIONI<\/u><\/strong><\/p>\n<p><span style=\"color: #333333;\">Il Fornitore del servizio comunicher\u00e0 su supporto durevole ai Creator interessati qualunque modifica proposta ai loro termini e delle loro condizioni.<\/span><\/p>\n<p><span style=\"color: #333333;\">Il Fornitore del servizio non potr\u00e0 imporre modifiche retroattive dei termini e delle condizioni, tranne nel caso siano tenuti a rispettare un obbligo normativo o regolamentare.<\/span><\/p>\n<p><span style=\"color: #333333;\">Le modifiche proposte non verranno applicate prima della scadenza di un termine di preavviso ragionevole e proporzionato alla natura e alla portata di tali modifiche e alle loro conseguenze per il Creator interessato. Detto termine di preavviso sar\u00e0 di almeno 15 giorni dalla data in cui il Creator informa gli utenti delle modifiche proposte.\u00a0<\/span><\/p>\n<p><span style=\"color: #333333;\">Il Creator interessato avr\u00e0 il diritto di risolvere il contratto con il Fornitore del Servizio prima della scadenza del termine di preavviso. Tale risoluzione ha effetto entro 15 giorni dal ricevimento della notifica delle modifiche proposte.<\/span><\/p>\n<p><span style=\"color: #333333;\">In qualsiasi momento dopo il ricevimento del predetto preavviso il Creator interessato pu\u00f2 rinunciare al termine di preavviso per mezzo di una dichiarazione scritta o di un azione chiara e affermativa.<\/span><\/p>\n<p><span style=\"color: #333333;\">Il Fornitore del Servizio si riserva il diritto di variare a propria discrezione, in qualunque momento, l\u2019interfaccia grafica della Piattaforma, i suoi contenuti e la sua organizzazione, nonch\u00e9 ogni altro aspetto che caratterizza la funzionalit\u00e0 e la gestione della stessa, comunicando per iscritto agli Utente, ove occorrenti, le relative istruzioni.<\/span><\/p>\n<p><strong style=\"color: #333333; font-size: 14.4px;\"><u>7. LEGGE APPLICABILE e FORO COMPETENTE<\/u><\/strong><\/p>\n<p><span style=\"color: #333333;\">I presenti Termini e Condizioni sono soggette alla legge italiana.
